Supreme Court grants protection from arrest to Married Sister in law of the deceased who is living separately from past 8 years in a case where is no material allegation against her in FIR.

The Hon'ble Supreme Court granted relief from arrest to married sister in law of the deceased in a recent matter led by Dr. Sarbjit Sharma, Advocate. In this case non-bailable warrants were issued against the sister in law, who was married and living separately for past 8 years, in a case where death of a lady was caused due to suicide committed by her. The sister in law was named in the FIR by the complainant family members of the deceased, however no material allegation was levelled against her in the FIR. even no role was assigned to her in the alleged offence causing the death of the deceased.

Usually in these cases the family members of the deceased i.e. the complainants, name all relatives of the husband of their deceased daughter in the FIR and the offence, since there is lot of anguish and anger for loss of the life of their loved one. However, in all the cases it is not so that all the family members of the Husband are involved in the offence. Mr. Sumit Sharma, Advocate and Direcetor Jurista Legalis, said that to fight for justice for those who are victims of the system is their sole aim.
